EXPERTS' DEPOSIT FUND
PURPOSE : (EXTRACT FROM STATUTES)
- To act as the depository, receiver or consignee of funds paid in by the judicial authorities or third parties designated by them, in connection with civil, criminal or administrative expert assessments.

- To act as the depository, receiver or consignee of funds in connection with arbitration or alternative procedures in particular those involving one or more members of Federation member associations acting as arbitrator, expert, conciliator or mediator.

- To administer said funds.

- To refund them in accordance with the conditions laid down by the appointing authorities, to the individuals or companies designated by them, - to receive by way of payment for this service, such sums which it shall determine in accordance with the scale of charges established by its Board of Directors or by the competent Court.

- To report to the appointing authorities upon completing its mission.

- To undertake and carry out all appointments in the general interest of the expert assessment, arbitration or alternative procedures.
WHAT CAN IT DO FOR YOU, FOR THOSE INVOLVED IN LEGAL PROCEEDINGS AND THEIR LEGAL REPRESENTATIVES ?
The CADEX is at your - and their - disposal to receive funds that it is ordered, or that it is simply necessary or desirable to place in the hands of a depository, a consignee or a receiver whilst awaiting a ruling concerning their final attribution, or to cover payment of tests, analyses or other works required in connection with the expert assessment, arbitration, conciliation or mediation procedure.
WHAT SHOULD I DO ?
If, during the course of legal proceedings of whatever type, such a deposit appears advisable then, on condition that the case is provided for under the statutes, you may propose this procedure to the magistrates, lawyers or any other party concerned. You should then proceed as follows :

- Prepare a written statement detailing the circumstances under which the deposit is being made, its ultimate destination and the sums involved ;

- Append, if applicable, the ruling(s) handed down or the agreement reached, as well as a note signed by you specifying the quality in which you are acting, the sum paid, the identity of the debtor, the conditions governing future refund or payment adopted by the interested parties (signed invoices, completion of works certificates, acceptance reports, etc.) and the bank details of the beneficiary or beneficiaries. The originals of these documents shall be provided the CADEX.

- Attach a cheque or banker's order payable to the CADEX (bank details provided upon simple request).
WHAT HAPPENS NEXT ?
- You will be informed the moment the funds have been credited to the CADEX and the original documents shall be returned after a signed certified copy has been obtained of same.

- You shall of course be responsible for the subsequent transmission, under the same conditions (originals sent under your cover), of the documents necessary for making refunds or payments, of which you shall also be advised, so that you may, if necessary, inform each of the parties. The corresponding original documents shall also be returned to their rightful owners.
